Terms of Service
By requesting a commission from me, you accept the terms I have stated below. Please read through each section carefully, so that you understand the entirety of my terms before requesting a commission from me. I have all my information listed here so that I can answer your questions as you read. The request form is listed at the bottom of this page.
General Terms:
- All drawings from me will come with a signature, called a watermark. This may not be removed or edited out in any way. I can provide an image without the watermark at the end of the process, but it MUST NOT be used for personal gain.
- Prices are subject to change depending on demand. I will not change my prices in the middle of a batch. I have all of my prices listed as they are on this page below.
-I have the right to refuse any commission for a legitimate reason or if I am not comfortable to fufill your request.
Revision and Changes:
- I allow 3 rounds of revisions to the work in progress piece. Any changes past that will be a $10 flat fee per change.
- If something major needs to be changed at the completion of the drawing, I charge 50% extra for my time. The only exception to this fee is if there was a misunderstanding on my part.
- If you wish for me to change something in the drawing you have previously approved, I will charge a fee which will be 15% of the total cost.
- References that are unclear or descriptions that are not helpful will have a $30 upcharge. By having to find my own references and build the character(s) for you, I use extra time, and it slows my process which eats into the time of other commissions.
Copyright and Usage Policy:
I, Fridge the artist, claim rights to the produced drawing. Therefore I am allowed to use the artwork I have produced for any of the following:- Promoting my work
- Display on websites or my personal gallery
- Publish in an artbook
- Post it to any of my social media or website.
You, as the buyer of the piece, are allowed to:
- Use the commission for personal use (profile pictures, social media, PC or phone wallpapers, backgrounds, stickers, emotes, etc.)
- Print the artwork for personal use (poster, small prints, stickers, etc.)
- Use the art work to promote yourself (credit to the artist is not forced, but greatly appreciated)
- Use the artwork for social media platforms that receive income (but the artwork itself can not be monetized in any way)
Any of the following is considered copyright infringement and can lead to legal action:- Reproducing or using the copyrighted artwork in a commercial setting
- Claiming the artwork as your own
- Removing my personal signature from the artwork
- Altering the piece in any way to claim that it is not my work.I reserve the full rights to the image and it's use and distribution. I do not do commercial commissions at this time, and to use my artwork for monetization is a direct infringement of my terms of service. By doing so, I will no longer work with you by all means.
Customer Satisfaction
- I want everyone to be happy with the results of the commissioned artwork.
- I will try my best to get the piece exactly how you want it, and if you dont like the outcome at all, I can allow 1 big change with a slight fee.
- If there is a problem with some of my terms, please negotiate with me first and we can come to an agreement before the commission begins. (for example: if you do not want me to post the art anywhere, we can discuss this upfront.)
- Please communicate any concerns or questions you have with my conditions and I will do my best to accommodate, though at the end of the day I am only human and want to promote my business.
Pricing
I have a google docs sheet laying out my prices for all drawings I can do and rates of any additional upcharges listed here. Please be sure to read through all of the prices to see my additional requests and offers.
Process and Delivery
- When I begin a commission, I will contact you via email or social media (depending on how you contacted me) and give an estimate of when the first stages will be done.
- Once I've begun the commission, and started to work on the beginning stages of it, I will not issue a refund. If you manage to catch me before I have started the sketch, I can issue a refund.
- I will provide progress reports as I complete parts of the request in the form of screenshots and previews of the work. During this time you can provide feedback and minor adjustments to the process.
- Any major changes such as changing the design, restarting, or adding additonal elements will count as an upcharge.
- The amount of time to complete the commission is variable. Depending on the complexity, detail, and references provided, it may take 1 - 2 days or up to 1 - 2 months. I will tell you a rough estimate of how long your request will take after collecting the info of your character.
- If anything interrupts my progress of the initially agreed upon delivery time, I will let you know immediately. If it impedes my ability to finish the commission and I am unable to complete your request, I will issue a full refund.
- Once the commission is completed, I will provide a full resolution image for download and a web friendly size so you can use to your hearts content.
Refunds and Cancellation
- Once the commission begins and I have confirmed a payment, there is no refunds.
- If I am unable to complete your commission, you will receive a full refund. If you still want the commission after I have issued the refund, I will automatically put you at the top of the waiting list.
- If you have issued a refund, do not request a chargeback. I will transfer the money back to you myself.
- If you request a chargeback through PayPal or Stripe at any point during the commission or after a cancellation, you will lose all aforementioned rights to the commissioned piece and I have full rights to profit from it further in any way I choose. I will decline the chargeback and supply PayPal or Stripe with conversations and evidence that I have started work for you. Furthermore, you will be banned and blacklisted from ever commissioning me again.
